Matt Kalil has ‘zero chance’ of winning lawsuit against ex-wife Haley Baylee: experts

Matt Kalil is unlikely to win his legal battle with his ex-wife, Haley Baylee, over her comments about his penis size, according to legal experts.

“The chances of this case ever going to trial are zero. It will either be dismissed or settled,” Los Angeles-based attorney Gregory Doll told Page Six. “It’s going to be tricky.”

For Kalil’s invasion of privacy claim, Doll explained that while he “probably meets the elements of the claim,” the two are “public figures,” despite the former NFL player insisting he has retired from public life in the lawsuit.

“There will be First Amendment issues as to Haley’s ability to talk about their sex life in public,” Doll, who is a partner at Doll Amir & Eley, said. “She’s hardly the first celebrity to do it, and there’s no bright-line rule that says that the subject matter is off limits.”

As for his unjust enrichment claim, the attorney claims a judge would decide if she’s “capitalizing on the story monetarily and if he should get some of that money.”

“The complaint notes she has over 30 million followers across the various social media platforms and has received numerous recognitions as a content creator,” Doll explained. “Maybe this story got her more followers, but ironically, his lawsuit probably doubles or triples that number.”

Doll continued on Kalil’s potential “motives,” saying, “I get the idea that he was married to a social media influencer with a big audience, that he’s remarried now with a young kid, and that he may not want her talking about his anatomy publicly.

“But the normal step – if protecting privacy were your primary concern – would be to send a cease-and-desist letter,” he added. “Then, only if she continued talking about the topic after receiving the letter, would you consider filing a lawsuit.”

The lawsuit does not mention whether a cease-and-desist letter was sent to Baylee.

Beverly Hills defense attorney Adam Michael Sacks agreed, explaining, “It doesn’t sound like he has much of a case. He’s a public figure, and the fact that he retired doesn’t make him not a public figure anymore.

“This case won’t go far.”

Reps for Baylee have not immediately responded to Page Six’s request for comment.

In a November 2025 Twitch stream, Baylee blamed their 2022 divorce on Kalil’s penis size.

“We were trying to do the damn thing and [putting in work in their marriage],” she told popular streamer Marlon.

“Deadass … for our whole marriage, deadass,” Baylee added. “But I was going to try it all. We tried it all: therapist, doctors. Not even lying … Looked up lipo-type s–t … That’s why it’s kinda funny. It’s like my life is a comedy, and it kinda writes itself. That was the biggest factor.”

The model claimed Kalil’s penis size is like “two Coke cans stacked on top of each other, maybe even a third.”

She ended, “We’ve tried, impossible unless you’re going to be in tears.”

Kalil remained silent until he filed the lawsuit on Tuesday.

In the court filing obtained by Page Six, he claimed her “degrading and deeply personal comments” caused him “unwanted attention and invasive commentary from the public.”

The former Minnesota Vikings player’s family members were also allegedly impacted negatively, including his wife, Keilani Asmus, who has received “disturbing” and “alarming” messages.

“Defendant shared these sensitive personal details about Plaintiff as entertainment for viewers and for her own financial gain even though Plaintiff reasonably expected they would remain private,” the lawsuit read. “Defendant’s choice to discuss such personal matters that were of no legitimate public concern was extreme, outrageous, and beyond all possible bounds of decency.”

He claimed to have suffered “severe emotional distress, humiliation, reputational damage and mental anguish.”

Kalil is requesting $75,000 in damages.

While Baylee has yet to respond to the lawsuit, the model told Page Six in a statement, “The truth is in the original livestream — which is still live on Marlon’s YouTube account. I speak highly of him in multiple ways throughout that conversation.

“I am genuinely shocked and incredibly hurt upon receiving the news of this filing,” she continued. “Litigation is a harrowing and emotionally draining experience, and I am heartbroken that he is choosing to subject us and our families to this ordeal.”

The athlete’s lawyer, Ryan Saba, responded in a statement to Page Six, “Haley Kalil disclosed private and intimate details about Matt Kalil that were of no legitimate public concern and subjected Matt Kalil and his family to widespread ridicule and unwanted attention.”

The lawyer added, “Haley Kalil shared these sensitive personal details about her ex-husband in an apparent quest to seek fortune and fame.

“Her actions were extreme, outrageous, beyond all possible bounds of decency, and have caused substantial harm to Matt Kalil, his family, and his business.”

Kalil and Baylee married in 2015 before she filed for divorce seven years later, citing “irreconcilable differences.”
