Dave Portnoy isn’t going to judge his favorite team’s star receiver without due process.

According to the police report, the 32-year-old Diggs faces charges of strangulation or suffocation, along with assault and battery, stemming from a Dec. 2 incident at his Massachusetts home, during which he allegedly attacked his personal chef following a money dispute.

Diggs and his lawyer vehemently denied the claims, while the Patriots issued a statement expressing that they “support Stefon” during the process.

Portnoy, 48, hopped on social media after the news broke to provide his reaction — a near three-minute video defending the four-time Pro Bowler, as well as his hometown team.

“First of all, in this great country of ours, America, it’s innocent until proven guilty,” Portnoy said, repeating the latter phrase multiple times throughout the recording.

“What team won the first Super Bowl after 9/11, that brought this country together and stood up for everything great about this country? The Patriots,” Portnoy declared. “So I believe in the rules of this country, innocent until proven guilty. I also know no team has taken the higher road, had better moral integrity than the New England Patriots.”

Portnoy continued, citing the high-profile — though, quite contradictory to his point — case of Aaron Hernandez.

“The second he got accused of murdering a bunch of people, before you could even say double homicide, he was cut, he was gone,” said Portnoy. “We don’t care, wins [or] losses, we look for good people, good humans.

“But again,” he reiterated, “this is innocent until proven guilty.”

The NFL vet is no stranger to controversy, a trend that’s continued since signing a three-year, $69 million contract with the Patriots ahead of the 2025 season.

A few months after signing, Diggs was seen on a boat passing around what appeared to be a mysterious pink substance to women draped in bikinis.

In September — two months before welcoming his first child with rapper Cardi B — Diggs was dealt a paternity suit from a woman named Aileen Lopera, who claimed that he was her daughter Charliee’s father, which was later confirmed by a paternity test.

Toward the end of November, online influencer Christopher Blake Griffith filed a complaint accusing Diggs of sexual battery — though Diggs countered with a libel lawsuit alleging the story was fabricated.

Despite being enmeshed in controversy, Diggs has tailored an impressive first season with the Patriots.

Sidelined for most of the 2024 season with the Texans from an ACL tear, Diggs has caught 82 passes for 970 yards and four touchdowns with perfect attendance for New England heading into Week 18.

He has bolstered MVP frontrunner Drake Maye’s receiving room amid a resurgent season for the Pats, who clinched the AFC East title in Week 17.

Still Diggs’ legal trouble could come to a head down the stretch.

The star wideout is currently set to appear in court for an arraignment on Jan. 23, just two days before the scheduled AFC championship game.
